When the WCB determines that there has been a compensation overpayment, it reviews the circumstances that resulted in the overpayment to see whether to recover or cancel the overpayment.
This policy is effective June 1, 2010, and applies to all decisions and administrative reviews on or after that date except when noted otherwise in a specific policy section(s).
Any compensation paid to a worker or worker’s dependant that is more than the worker or dependant is entitled to is a compensation overpayment. Compensation overpayments also include excess payments paid on assignment to the worker’s employer (see Policy 04-09, Part II, Application 1, Question 5).
