Policy                              

If the WCB is of the opinion that it is in the best interest of the worker or dependant, compensation payments may be allocated in part or in full to a person other than the worker or dependant.

This consolidated policy is effective February 15, 1997, except when noted otherwise in a specific policy section(s).

Interpretation

1.0 Compensation Payments

These include any periodic compensation, allowances or benefits that the WCB pays to a worker as a result of a compensable disability.

2.0 A Person other than the Worker or Dependant

Compensation payments may be allocated to: 

  • the employer
  • the worker's dependant who would otherwise not receive compensation
  • the worker's guardian or trustee
  • the office of the Public Trustee
  • others as approved by the WCB.
