Chapter: Benefits
Subject: Temporary Benefits
Authorization: Board of Directors resolution 1996/10/53
Date: November 26, 1996
Reference: Workers' Compensation Act, RSA 2000, Sections 36, 38(1), 52, 54, 56, 63, 137.1
General Regulations, Sections 1, 15

Policy:

When a work injury results in temporary loss of earnings, the WCB pays the worker temporary total disability or temporary partial disability benefits, based on the nature and degree of disability, for as long as the disability lasts.

The WCB may pay allowances for travel or subsistence expenses or both when workers are required to travel and/or stay away from home to attend WCB directed appointments.  As well, the WCB may pay a wage loss allowance if workers lose wages as a result of attending WCB directed appointments.

This consolidated policy is effective February 15, 1997 unless noted otherwise.  Any exceptions are noted with the specific policy sections.

Interpretation

1.0 Temporary Total Disability

Temporary total disability occurs when a compensable work injury or occupational disease results in temporary work restrictions which prevent a worker from performing the accident job and/or any concurrent employment.

2.0 Temporary Partial Disability

Temporary partial disability usually occurs during convalescence from the injury when medical evidence supports a worker returning to a modified version of the pre-accident or other suitable job, consistent with identified temporary work restrictions.
